Is the state's workers' compensation system under attack?

During Governor Bruce Rauner’s recent State of the State address, he called for reforms to the state’s workers’ compensation system. Compared to other states, Illinois has the nation’s seventh-highest premiums.

Yet readers should not interpret that ranking with accessibility. To the contrary, injured workers still encounter resistance when submitting workers’ compensation claims. Our law firm has witnessed this struggle firsthand. We have fought for workers with on-the-job injuries for the past several decades.


One common obstacle involves functionality evaluations. Your employer’s insurance company generally provides its own medical consultant. That evaluation report is then used to estimate your wage-earning capacity. We cannot overemphasize the importance of having legal representation during this step. Depending on the situation, we may seek a second medical opinion. We will also take the time to listen to you and work with your health care providers to determine whether you can return to work, whether you need lighter duties, and other issues. 

Another obstacle often involves an employee’s fears for his or her own job security. Remember, you have legal rights. If your employer has not offered you a fair benefits package, you have the right to appeal to a panel from the Workers’ Compensation Commission.

If reforms to the state’s workers’ compensation system are needed, they should be directed to abuses in the system. Denying an injured worker the benefits he or she deserves simply creates more administrative cost for everyone involved.
